1. Agreement
These Terms of Service ("Terms") govern your access to and use of the website operated by ThirdHouse ("ThirdHouse", "we", "us"), and any services provided by ThirdHouse. By using this site or engaging our services, you agree to these Terms.
2. Services
ThirdHouse provides paid social media advertising, creative production, and growth consulting services under separate written engagement agreements. This website is informational; nothing on it constitutes a binding offer to provide services.
3. Engagements & Payment
Specific scope, fees, deliverables, and timelines are defined in an individual Statement of Work or engagement agreement executed between ThirdHouse and the client. Retainers are billed monthly in advance unless otherwise agreed in writing.
4. Client Responsibilities
Clients are responsible for the accuracy of information they provide, for ownership of and rights to any assets (brand, product, copy, imagery) supplied to ThirdHouse, and for the compliance of their products and claims with applicable laws and platform policies.
5. Intellectual Property
Content on this website, including logos, copy, and design, is owned by ThirdHouse and may not be reproduced without permission. Deliverables produced under a client engagement are owned by the client upon full payment, as further described in the engagement agreement.
6. Results & No Guarantees
Marketing outcomes depend on many variables outside our control. ThirdHouse does not guarantee specific ROAS, revenue, or performance results. Any figures on this site refer to historical work with specific clients and are not a prediction of future results.
7. Confidentiality
Both parties agree to keep non-public information shared during an engagement confidential and to use it solely for the purpose of that engagement.
8. Limitation of Liability
To the fullest extent permitted by law, ThirdHouse's total liability arising out of or related to these Terms or any engagement will not exceed the fees paid by the client to ThirdHouse in the three (3) months preceding the event giving rise to the claim.
9. Third-Party Platforms
Our services rely on third-party platforms (e.g. Meta, TikTok, Google). ThirdHouse is not responsible for changes, outages, account actions, or policy decisions made by those platforms.
10. Termination
Either party may terminate an engagement in accordance with the termination terms of the applicable engagement agreement. Fees earned through the effective termination date remain payable.
11. Governing Law
These Terms are governed by the laws applicable to the jurisdiction in which ThirdHouse operates, without regard to conflict-of-law principles.
12. Changes
We may update these Terms from time to time. Updates take effect when posted on this page. Continued use of the site or our services constitutes acceptance of the revised Terms.
